Terms of service

Terms of Service

These Terms of Service apply to all consumer purchases made via our online store within the European Economic Area (EEA). Your statutory consumer rights under EU and national law are not affected by these terms.

1. The Agreement

The agreement consists of these Terms of Service, the information provided in the checkout process, and any separately agreed terms. In the event of a conflict, any individually agreed terms will take precedence, provided they do not contravene mandatory consumer protection laws.

2. The Parties

Seller: Annette Undheim Photography, VAT No. 927145561, Email: email@annetteundheimart.com (referred to as "we", "us", or "the seller").

Buyer: The consumer placing the order (referred to as "you", "your", or "the buyer").

3. Prices

All prices are stated in the relevant currency and include VAT where applicable. The total price you agree to includes all applicable charges. You will not be charged additional costs unless clearly stated before completing your purchase.

4. Formation of Contract

The contract becomes binding once you have submitted your order and received an order confirmation.
We reserve the right to cancel an order in case of obvious errors or inaccuracies in pricing or availability.

5. Payment

Payment is due at the time of order unless otherwise agreed. Payment methods include credit/debit card, PayPal, or other methods shown at checkout. For card payments, the amount will be reserved upon ordering and charged when the goods are shipped.

6. Delivery

Delivery is considered completed when the product is physically received by you or a person on your behalf.
Unless otherwise specified, we will deliver within 12 days of the order.

7. Risk and Ownership

Risk of loss or damage passes to you upon delivery. Ownership remains with the seller until full payment has been received.

8. Right of Withdrawal (14-Day Return Period)

As an EU consumer, you have the right to cancel your purchase within 14 days of receiving the goods, without providing any reason.
To exercise this right, notify us by email or use the cancellation form (not mandatory). You then have another 14 days to return the product.

You are responsible for the cost of returning the goods unless otherwise agreed. Items must be returned in original condition and packaging. You may inspect the product to determine its nature, features, and function, but any excessive handling may reduce your refund.

We will refund the product price (excluding shipping costs) within 14 days of receiving your return, or proof that it has been shipped.

Note: Custom-made or personalised items (e.g. prints in special sizes or colours) are not eligible for return.

9. Delays and Non-Delivery

If we fail to deliver the product on time and this is not your fault, you may withhold payment, demand fulfilment, cancel the purchase, and/or claim compensation.
Contact us as soon as possible if you experience issues.

10. Defects and Complaints

If the product is defective, you must notify us within a reasonable time. You always have the right to complain within two months of discovering the defect.
The legal warranty is valid for two years from the date of delivery (or five years if the item is expected to last significantly longer).

Your rights may include repair, replacement, a price reduction, cancellation, and/or compensation.

11. Seller’s Rights in Case of Buyer’s Breach

If you fail to pay or otherwise breach your obligations, we may withhold delivery, demand fulfilment, cancel the contract, and/or claim damages.
Uncollected packages may be subject to a fee to cover our return costs.

12. Guarantees

Any additional warranties provided by the seller or manufacturer do not affect your statutory consumer rights.

13. Personal Data

We process your personal data in accordance with the General Data Protection Regulation (GDPR). We only collect and store data necessary to fulfil our contractual obligations and will not share your information without your consent unless required by law.

14. Dispute Resolution

We aim to resolve any issues amicably. If unresolved, you may contact your national consumer authority or use the EU Online Dispute Resolution platform: http://ec.europa.eu/odr
